A: Language won’t spare you from probate in Florida. All wills are subject to probate when there’s a transfer at death of Florida real estate held in the name of the deceased, says lawyer David Altro, who practises in Florida and Quebec. “The best way to avoid the probate expense and hassle is to have title to the property in a cross-border trust,” Altro said. “Upon death the property will be transferred to the person so designated in the trust without probate.”
